Ltd., (“Company”, “we”, “us” and “our”), a private limited company established under the laws of India, Companies Act 2013, having its registered office at Plot No. 9P, Co-operative Bank Colony, Nagole, Hyderabad, 500068.

Upskill Generative AI is a specialized online learning platform focused on providing high-demand training programs in Artificial Intelligence, Machine Learning, Generative AI, Data Science, and related emerging technologies. The Platform collaborates with industry experts and corporate partners to design courses that combine concept mastery, real-time projects, live internships, and placement assistance.

Our programs are delivered through live instructor-led classes, on-demand learning resources, hands-on labs, and capstone projects, ensuring learners gain both theoretical knowledge and practical implementation skills. For the purpose of these Terms of Service (“Terms”), unless the context otherwise requires:

  • The terms “you” and “your” refer to the user, learner, or visitor accessing or registering on the Upskill Generative AI Platform.

  • The term “Services” refers to the training programs, courses, mentorship, learning management system (LMS) access, career support, placement assistance, and other educational services offered by us on the Platform.

  • The term “Products” refers to any digital learning resources, certifications, course materials, or related offerings made available by us on the Platform.

  • “Third Parties” refer to any external applications, companies, service providers, or individuals apart from the User, Trainers, and the Company that may interact with or integrate into the Platform.

  • “Personal Information” shall mean and include any personally identifiable information that we may collect from you such as Name, Email ID, Mobile Number, Password, Photograph, Educational/Professional Details, or any other data required for availing our Services.

  • “Trainers” shall mean the industry experts, mentors, and instructors delivering courses or guidance through the Upskill Generative AI Platform.

  • “Users” shall mean all individuals who access, browse, or use the Platform, which includes learners, students, professionals, and trainers.

GENERAL TERMS

General Provisions

  • The headings provided herein are for ease of reference and organizational purposes only. They shall not be construed to hold any legal or contractual effect between the parties.

  • These Terms of Service, when read together with the Disclaimer Policy and Privacy Policy, constitute the complete and binding agreement between the User and Upskill Generative AI with respect to the subject matter herein, and shall supersede any prior communications, understandings, or agreements (whether oral, written, or otherwise).

  • By accessing or using the Upskill Generative AI Platform, you acknowledge and agree that you have read, understood, and consented to these Terms. Your continued use of the Platform shall be deemed as acceptance of the Terms in full.

  • The Company reserves the exclusive right to modify, amend, update, or delete any provision of these Terms and Conditions at its sole discretion. Such amendments shall be binding upon all Users, and it is your responsibility to review the Terms and the Privacy Policy periodically prior to using the Platform.

  • Continued usage of the Platform or Services after any such updates constitutes your consent to be bound by the revised Terms. If you do not agree with the Terms at any point, you must discontinue use of the Platform immediately.

User Consent and Responsibilities

  • The User grants Upskill Generative AI the right to collect and use their information strictly for legitimate purposes as outlined in these Terms and the Privacy Policy. All use of personal data shall comply with applicable laws and ethical practices.

  • The User agrees not to publish, transmit, or share any content through the Platform that is false, misleading, harmful to minors, abusive, offensive, unlawful, or disruptive to public peace and order.

Enrollment Process

i. After selecting a service, add it to your Cart. On pressing “Checkout” or “Complete Order”, you will be directed to the secure payment gateway.

ii. Once payment is confirmed, your enrollment will be successfully registered. You will receive a confirmation email with details of your upcoming batch.

iii. All further course-related information, updates, and announcements will be communicated through our official Platform.

REGISTRATION

To access and avail any training programs, mentorship, or placement services offered on the Upskill Generative AI Platform, registration is mandatory for all learners and users.

During the registration process, you will be required to provide the following accurate and up-to-date information:

c. Full Name
d. Residential Address & Current Location
e. Payment Information (for subscription and course enrollment)
f. Company / University / Institution you are currently associated with (if applicable)

ELIGIBILITY

Eligibility & User Representation

By accessing or using the Upskill Generative AI Platform, you represent and warrant that you are competent, of legal age, and eligible to enter into a legally binding agreement in accordance with applicable laws.

  • If you are a minor, you may use the Platform only with the consent and supervision of your legal guardian. All actions taken by a minor shall be deemed to be carried out under the guidance and responsibility of their guardian.

  • You further represent that you will comply with these Terms of Service, along with all applicable local, state, national, and international laws and regulations.

  • You shall not use the Platform if you are not legally competent to contract or if you are otherwise disqualified under applicable law.

The Platform reserves the right to restrict or terminate your access if it discovers at any stage that you are ineligible, have provided false information, or have breached these Terms or the Privacy Policy.

The Platform may also use security checks and verification algorithms to validate the authenticity of user activity, for which your implied consent is deemed granted.

Conditions for Using Our Services

You may use our Services only if you:

  1. Can form a binding contract with Upskill Generative AI.

  2. Comply with these Terms, all applicable laws, and our policies (including the Disclaimer Policy, Privacy Policy, course-specific eligibility requirements, and any other applicable rules).

  3. Provide accurate and complete information when creating your account, and agree to update it regularly to keep it current.

Any violation of our Terms, applicable laws, or policies may result in your access to the Services being suspended, disabled, or terminated.

License to Use

Subject to compliance with these Terms and our Policies, Upskill Generative AI grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your personal, non-commercial learning purposes.

You also agree that:

  • You will create and use only one user account, unless expressly permitted otherwise.

  • You will not share your account login credentials with any third party.

  • Using our Services does not grant you ownership of or any intellectual property rights in the Services or the content you access.

Restriction on Commercial Use

Any use of our Services for commercial purposes is strictly prohibited unless covered under a separate written agreement with Upskill Generative AI.

  • If you are an organization or corporate entity availing Services for your employees or teams, separate contractual terms shall apply.

  • These Terms do not govern the relationship between your organization and Upskill Generative AI, which shall be regulated by the specific corporate training agreement executed with us.

Pricing

Access to the Upskill Generative AI Platform is free for users to browse and explore. However, to enroll in our training programs, mentorship sessions, certifications, or placement services, fees are applicable as per the course or product selected.

  • The Company reserves the right to determine and update pricing for its Services at its sole discretion.

  • Any applicable platform fees, taxes, or surcharges (such as transaction charges, limited availability of instructors, or other operational factors) may be added at checkout.

  • All pricing details are transparently displayed on the Platform prior to purchase.

Payment Gateway

For completing payments, you will be securely redirected to a third-party payment gateway integrated with our Platform.

  • The payment gateway may require you to provide additional details (such as card information, OTP, UPI ID, etc.) to process transactions.

  • Available options include Credit/Debit Cards, Net Banking, UPI, and popular digital wallets.

  • Please note that the use of the payment gateway is governed by the respective payment provider’s Terms and Conditions and Privacy Policy, and additional processing charges may apply.

  • Upskill Generative AI does not store your sensitive payment details and shall not be liable for any issues arising directly from the third-party gateway.

Content

All text, videos, lectures, graphics, images, write-ups, presentations, trademarks, logos, and other materials made available on the Platform (collectively, “Content”) are either:

  1. Created by Upskill Generative AI instructors and mentors, or

  2. Provided by users, learners, or third parties.

  • We strive to maintain accuracy and quality, but we do not guarantee the authenticity, completeness, or reliability of third-party content.

  • All content displayed on the Platform is protected under copyright and intellectual property laws. You may access it solely for personal, non-commercial learning purposes.

  • You shall not copy, distribute, adapt, or modify any content without prior written approval from Upskill Generative AI or the respective copyright owner.

User Content

  • If you upload, submit, or share content on the Platform (such as assignments, project files, or feedback), you grant Upskill Generative AI a worldwide, royalty-free, perpetual, sublicensable, non-exclusive license to use, distribute, display, and create derivative works from such content for educational purposes.

  • The Platform reserves the right to suspend or terminate any account found to be sharing false, misleading, offensive, vulgar, or harmful content.

  • You shall be solely responsible for any financial, reputational, or legal consequences resulting from the submission or sharing of inaccurate or unlawful content.

Third-Party Content

  • Through the Services, you may encounter content from instructors, mentors, users, or third-party websites.

  • Upskill Generative AI does not guarantee that such content will be free from objectionable material, malware, or other risks.

  • We disclaim all liability for issues arising from your access to, or use of, third-party content.

Indemnity

You agree to indemnify, defend, and hold harmless Upskill Generative AI, its parent company (LNTeks Technologies Pvt. Ltd.), affiliates, directors, officers, employees, mentors, and agents (collectively, the “Parties”) from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) that may arise from or be related to:

  • Your use of the Platform or Services;

  • Your violation of these Terms of Service;

  • Your violation of any rights of another individual or entity;

  • Your breach of any representations, warranties, or obligations under these Terms;

  • Any improper or unlawful conduct in connection with your use of the Platform.

You agree to cooperate fully with Upskill Generative AI in defending such claims, and you shall not settle any matter without our prior written consent.

In no event shall we be liable to compensate you or any third party for any special, incidental, indirect, consequential, or punitive damages, including but not limited to loss of use, data, profits, goodwill, or reputation, arising from your use of or access to the Platform and Services.

Limitation of Liability

To the fullest extent permitted by law, Upskill Generative AI shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, resulting from:

  • Connectivity errors, internet failures, or technical disruptions;

  • Incorrect information or data provided by you;

  • Delays in communication or non-receipt of updates via email or Platform;

  • Deficiency, defect, or interruption in the Services;

  • Unauthorized access to, alteration of, or use of your data;

  • Any conduct or content of users, trainers, or third parties, including defamatory, offensive, or illegal conduct.

In no case shall Upskill Generative AI’s aggregate liability exceed the greater of:

  • The total fees paid by you for the paid Services in question, or

  • INR _________ (Rupees _________ only).

You acknowledge that:

  • The Platform and its Services are provided on an “as-is” and “as-available” basis without warranties of accuracy, completeness, or uninterrupted availability.

  • While we strive to provide quality training, mentorship, and placement guidance, we do not guarantee individual success, job placement, or career advancement.

  • Any cause of action must be initiated within one (1) year from the date the claim arose, failing which it shall be permanently barred.

Your sole and exclusive remedy for dissatisfaction with the Platform or Services is to discontinue your use of the Platform.

Term

  • These Terms of Service shall remain valid and binding for as long as you continue to access and use the Platform.

  • You may terminate your use at any time by deleting your account.

  • We reserve the right to suspend or terminate your account and access to the Platform, without prior notice, in the event of a breach of these Terms, legal issues, or other violations.

  • Such suspension or termination shall not limit our right to pursue any other remedies available under law.

  • The Company reserves the right to discontinue the Platform or Services at its sole discretion without prior notice.

Termination

  • Upskill Generative AI reserves the right, at its sole discretion, to suspend or terminate your access to the Platform or any portion thereof at any time, without prior notice or liability.

     

  • We may also deny or restrict access to certain Services or features of the Platform, or modify/add/remove features, in order to safeguard the interests of the Platform and its Users.

     

  • You shall continue to remain bound by these Terms of Service during the period of your access, and you acknowledge that you cannot unilaterally terminate these Terms except by discontinuing your use of the Platform and deleting your account.

     

Communication

  • By registering on the Platform and providing your contact details, you consent to receive emails, SMS, phone calls, or in-app notifications from Upskill Generative AI and/or its authorized representatives regarding your use of the Services.

     

  • You may report any discrepancies or content-related concerns to support@upskillgenerativeai.com, and we will investigate and take necessary corrective action, if required. Resolution timelines will depend on the complexity of the issue.

     

  • You expressly acknowledge that we may contact you with respect to services availed by you, enrollment updates, payments, placement support, or other matters related to your use of the Platform.

     

  • All communications and information shared shall be governed by our Privacy Policy.

     

User Obligations & Code of Conduct

As a registered User of Upskill Generative AI, you agree and acknowledge that you are a restricted user of the Platform and shall:

  1. Provide Authentic Information

     

    • Furnish only genuine and accurate details during registration and throughout your usage of the Platform.

       

    • Keep your name, email, phone number, address, and other relevant information updated at all times.
  2. Maintain Account Security

     

    • Be solely responsible for maintaining the confidentiality of your account and login credentials.

       

    • You must promptly notify us of any unauthorized access to or use of your account. We reserve the right to suspend or close your account if necessary.

       

  3. Respect Data & Usage

     

    • Understand that all data entered on the Platform is stored securely and used for course delivery, progress tracking, personalization, and placement-related services.

       

    • Authorize Upskill Generative AI to process your personal information, reviews, feedback, and activity for educational, marketing, and service optimization purposes.

       

  4. Restricted Activities

     

    • Not cut, copy, modify, recreate, reverse engineer, distribute, or publish any part of the Platform or its content without prior written permission.

       

    • Not use bots, spiders, scraping tools, or automated methods to access or extract content from the Platform.

       

    • Not attempt to bypass or manipulate the structure, security, or functionality of the Platform.

       

  5. Content Responsibility

     

    • Acknowledge that user-generated content (such as comments, discussions, or shared materials) belongs to the respective creators and not Upskill Generative AI.

       

    • Agree not to share content that is false, misleading, offensive, vulgar, discriminatory, or harmful. Any reported objectionable content may be removed at our sole discretion.

       

  6. Prohibited Conduct

     

    • Refrain from uploading, posting, or engaging in any conduct that violates applicable law, breaches intellectual property rights, or disrupts the learning environment of the Platform.

Prohibited Activities

By using the Upskill Generative AI Platform, you expressly agree that you shall not:

  1. Disrupt Platform Functionality

    • Engage in any activity that interferes with or disrupts the Platform, its servers, networks, or connected services.

    • Attempt to probe, scan, or test the vulnerability of the Platform or breach security/authentication measures.

  2. Misrepresentation & Impersonation

    • Impersonate any individual, trainer, mentor, or organization, or misrepresent your affiliation with any person or entity.

  3. Unauthorized Data Access

    • Reverse engineer, trace, hack, mine, or otherwise attempt to gain unauthorized access to any User account, data, or information stored on the Platform.

  4. Illegal & Harmful Activities

    • Upload, post, or share content that is unlawful, abusive, defamatory, obscene, pornographic, hateful, discriminatory, or otherwise objectionable.

    • Share content that violates intellectual property rights, privacy rights, or any applicable laws.

    • Spread viruses, malware, or any harmful software intended to damage the Platform or other Users’ systems.

  5. Misuse of Services

    • Use the Platform or its content for any commercial or promotional activity without prior written consent.

    • Violate any code of conduct, guideline, or additional policies applicable to our Services.

    • Engage in deceptive practices such as providing false or misleading information, incomplete registrations, or fraudulent activities.

The Platform reserves the right to disclose user information to law enforcement or governmental authorities if required by law or in cases involving suspected criminal activity, intellectual property violations, or threats to public order.

Suspension of User Access

We may, at our sole discretion, suspend, restrict, or terminate your access to the Platform without prior notice if:

  • You are found to be in violation of these Terms of Service or the Privacy Policy.

  • You provide false, incomplete, or misleading information.

  • Your actions cause harm, legal risk, or damage to the Platform, its reputation, or its Users.

Such suspension or termination shall be in addition to any legal remedies available under applicable law.

Intellectual Property Rights

  • All logos, trademarks, service marks, course content, designs, and graphics created by or for Upskill Generative AI are the exclusive property of the Company.

  • You are not permitted to use, reproduce, or distribute any intellectual property belonging to the Platform without prior written approval.

  • Independent content created and uploaded by instructors, mentors, or users remains the property of its respective creators. The Platform only provides the medium for its display.

  • Any reproduction or infringement of intellectual property rights shall invite legal consequences.

  • These obligations survive the termination or expiry of these Terms of Service.

Disclaimer of Warranties & Liabilities

  1. You agree that you are accessing the Platform and Services at your sole risk, and you shall exercise prudent judgment before relying on any content, training, or recommendations.

  2. Upskill Generative AI provides Services, features, and content on an “as-is” and “as-available” basis, without warranties of accuracy, reliability, or uninterrupted availability.

  3. We do not guarantee that the Platform will be free of errors, interruptions, or viruses, and you expressly accept the associated risks of using the Platform.

  4. No oral or written advice, guidance, or recommendations provided by trainers, mentors, or representatives shall create any warranty or liability beyond what is explicitly stated in these Terms.

  5. These disclaimers and limitations of liability shall continue to apply even after termination or expiry of these Terms of Service or the Privacy Policy.

Force Majeure

Upskill Generative AI shall not be held liable for any delay, interruption, or failure in the performance of its obligations under these Terms if such delay or failure is caused by circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of God, war, riots, fire, flood, pandemic, cyber-attacks, hacking, piracy, technical failures, power outages, labor disputes, government restrictions, or interruptions in internet connectivity.

Dispute Resolution and Jurisdiction

  • Any dispute, controversy, or claim arising out of or relating to the use of the Platform or interpretation of these Terms shall first be resolved through mediation administered by the Centre for Online Resolution of Disputes (CORD), as per CORD Rules of Mediation.

  • If mediation fails within 45 days, the dispute shall be referred to arbitration under the Rules of Arbitration of CORD. The arbitration shall be conducted in English, with the seat of arbitration in Hyderabad, India.

  • These Terms, Privacy Policy, and all agreements shall be governed and construed in accordance with the laws of India.

Grievance Redressal & Platform Security

In compliance with the Information Technology Act, 2000, the IT (Intermediary Guidelines) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2021, the following officer has been appointed for user grievances:

Miscellaneous Provisions

a. Entire Agreement
These Terms of Service, along with the Privacy Policy, Disclaimer Policy, and Cookie Policy, constitute the complete agreement between you and Upskill Generative AI, superseding all prior understandings.

b. Waiver
Failure by Upskill Generative AI to enforce any provision of these Terms at any point shall not constitute a waiver of the same provision in the future.

c. Severability
If any provision is found invalid, unlawful, or unenforceable, the remaining provisions shall remain fully effective. The invalid portion will be modified only to the extent necessary to make it enforceable while preserving intent.
